I am familiar with the Federal Tort Claims Act, the administrative claims process, and the way that the United States Attorney’s office defends these claims. I have handled many of these claims for individuals who have been injured as a result of the negligence of the Federal Government, and other attorneys have referred their clients, to me, to handle their Federal Tort claims.

Some attorneys do not like to handle these claims because they are not familiar with the procedural requirements. Other attorneys do not like to handle these cases because the law limits the contingency fee that can be charged to either twenty percent or twenty-five percent, (28 U.S.C § 2678) instead of the 33 1/3 percent contingency fee, which is the maximum permitted, under most circumstances, all of my contingency fee agreements include the statutory fee limitations, so that the client is informed about them, at the beginning of the case. I have never charged a client more than the US Code allows for handling a Federal Tort Claim.

The Federal Tort Claims act involves several procedures that are different than the procedures, which are used to handle a claim against an ordinary individual:

1. A proper administrative claim must be filed with the appropriate Federal Agency within two years.

2. The time for filing a complaint is governed by when the Federal Agency denies the claim. In some cases, you may have to file your case as soon as six months after your accident, and in other cases, you may have more than two years from the date of your accident to file your claim.

3. You must file your complaint in the appropriate United States District Court. There have been cases where this step was not completed properly and the claimant’s case was dismissed.

4. You must serve your complaint on the appropriate U. S. Attorney and the Attorney General of the United States. Three are cases where this step was not completed properly and the claimant’s case was dismissed.

5. The Federal Government is not an insurance company. A Federal Tort claim can only be made if the Federal employee was acting in the “scope of his employment”. In some cases, the Federal Government will not be responsible for the actions of its employee and you may have to file a complaint against the individual in the appropriate court. Sometimes the statute of limitations against the individual employee, maybe different than the statute of limitations against the Federal Government.

6. You are not entitled to a jury trial. Your claim will be decided by a United States District Court Judge, without a jury.

7. The maximum attorney’s fee is 20% for cases that are settled before suit is instituted and 25% for cases that are put into a suit. (28 USC §2678)

Bees, Wasps, and Hornets – The Flying Stingers We Fear

These are pests that we have a love-hate relationship with. Yes, we love to see all the pollinators doing what they do best and that’s keeping flowers and plants, well pollinated. They fly from flower to flower buzzing happily doing what they’re meant to do and doing it very well. We remain quietly at a safe distance, taking time to smell the flowers and watching nature hard at work when suddenly, much to our dismay, we are noticed and now we get attacked and stung.

You may ask, “What did I do?” Sorry, you’re not the first nor will you be the last person stung without provocation. It could be a color we wore or a cologne/perfume we have on or maybe a sudden movement. Who knows? All we know is, we are now a victim of some little insect’s right for protection. Then we turn and notice a large wasp nest in the eave of our home. What now?

Bees are probably the nicest of the stingers. They are a social little bunch and tolerate a lot before attacking. One good reason is they can only sting once, yes it’s a kamikaze attack for them and they’re not in too much of a hurry to end it. I think their view is “so many flowers and too little time to pollinate them all” so they don’t want to give it all up on a whim. You have to be threatening the hive or them before the sting comes.

Yellow Jackets are by far the meanest of the group. They most definitely attack without provocation and unlike bees, they can sting multiple times. Wasps also can sting multiple times and there is a wide variety of them around. Also, there is a large variety of hornets but don’t forget the feisty bumblebee. He’s an ill-tempered little bully too.

The question asked earlier was what to do once your home has been invaded by these stinging pests. Do not attempt the extermination yourself. You may find yourself getting more than you bargained for and you or a family member could even end up in a hospital. Call a professional exterminator for the Yellow Jackets, Wasps, Hornets or Bees. You may even consider an experienced Bee Keeper for the Bees. We, as exterminators don’t really like to kill Bees but if they are a danger to you and your family, you come first.

One-Piece Showers

One-piece showers offer the least possibility for problems of all the various types of showers. Because of their one-piece construction, leaks in the walls are nearly unheard of. Unless the unit is cracked, you can rule out wall leaks.

Valve Escutcheons

The valve escutcheons on showers are one source of mystery leaks. Just as was described in the last chapter, these escutcheons can let water penetrate the shower wall.
The escutcheons used for single-handle valves are frequently equipped with sponge-type gaskets. These gaskets are factory installed on the escutcheons and do a good job of preventing unwanted leaks.
Two-handle shower valves generally require a gasket or a putty seal to be placed behind the escutcheons. If these seals are missing or have deteriorated, water can find its way into the wall. A visual inspection can reveal the possibility of this type of leak, but a water test is the only way to be certain the escutcheons are not responsible for leaks.
Unfortunately, many showers don’t have access panels that allow easy inspection of the shower valve. Bathtubs that use waste and overflows with mechanical joints are required to have access panels, but showers are not.
The lack of an access panel greatly reduces a plumber’s ability to make sound judgment calls on problems related to showers. It may be necessary to cut into a wall to gain access in the case of stubborn leaks, but there are ways to make reasonable assumptions without butchering a wall. To expound on this, let’s look at various circumstances on a step-by-step basis to see how cutting into walls and ceilings can be avoided.

Tubs That Won’t Hold Water

Tubs that won’t hold water generally require an adjustment to the tub waste. It is possible for water to leak around the trim ring of the tub drain, but the problem is usually with the adjustment of the tub waste. If there is no water leaking from under the tub, you can rest assured the cause is in the tub waste adjustment. There are several different types of tub wastes in use, and each of them can present its own type of trouble. With some types of wastes, it is necessary to make adjustments in the trip mechanism. Others require the replacement of a seal or an entire stopper.

Toe-touch wastes

Toe-touch wastes don’t contain any internal adjustment mechanisms. This type of waste depends on the stopper to hold water in a bathtub. If a toe-touch waste is allowing water to leak out of the tub and down the drain, there are three options available to you.
Begin your troubleshooting by turning the stopper clockwise. If the stopper is not screwed into the drain far enough, water can leak past its seal. If the stopper is screwed into the drain properly, remove it and inspect the seal. To be sure the problem is with the toe-touch stopper, install a rubber stopper in the drain and test the tub. If water doesn’t leak past the rubber stopper, you have identified the cause of your problem; it is the toe-touch stopper.
Once you know the stopper is causing the trouble, you can replace the entire stopper with a new one. It may be possible to replace the seal only, but with the low cost of replacement stoppers, I would replace the whole unit to be sure of correcting the problem without a callback.
